AFFIDAVIT AND NOTICE OF LOSS Owner’s Duplicate Copy of the Original Certificate of Title No. (P-34434) 7183 registered in the name of THE HEIRS OF MARIA UCHALE OREAS
I, SERGIO F. OREAS, of legal age, widower of the late Gloria A. Oreas, Filipino with residence and postal address at 16-E Zamboanga Alley, Intan Street, Bagong Barrio, Caloocan City, after first being sworn to in accordance with law hereby depose and say:
1. That, I am one of the legitimates of the late CRISPIN U. OREAS, SR. who died intestate in Alaminos, Pangasinan on 8 October 1974 and who is one of the four (4) legitimates of the late MARIA UCHALE OREAS who died intestate in Bani, Pangasinan;
2. That, by virtue of intestate succession, I am one of the co-owners and legitimate successors of a portion of that certain real estate property belonging to my late father, CRISPIN U. OREAS, SR., more particularly described as follows:
A portion of that real estate property comprising of a total lot area of SIX HECTARES AND SEVEN HUNDRED AND SEVERY-THREE SQUARE METERS (6.773 h) more or less, located in Barrio Tipor (Ambabay), Bani, Pangasinan with Original Certificate of Title No. (P-34434) 7183 registered in the name of THE HEIRS OF MARIA UCHALE OREAS before the Register of Deeds of Alaminos, Pangasinan.
3. That, on or about late 2002 when our ancestral home in Poblacion Bani, Pangasinan was demolished for construction of a new commercial/residential building, several old furniture as part of the home fixtures of the old structure were equally demolished and disposed by the contractor;
4. That, along with the disposed furniture, particularly that old study table where several important documents were kept that most likely included the above described title, the original of the Owner’s Duplicate Copy of Title that is subject of the foregoing was never seen again since;
5. That, notwithstanding diligent efforts to recover the missing certificate of title, the same cannot be found to this date; and,
6. That, I am executing the foregoing Affidavit by virtue of the Extrajudicial Summary Settlement of Estate of the above named decedents executed on 28 August 2013 in the City of Malabon, Metro Manila, Philippines, before Atty. Dionisio B. Apoya Jr., a Notary Public (as per Doc. No. 827, Page No. 162, Book No. 1111, Series of 2013 of his Notarial Registry and duly published in People’s Monitor, a newspaper of national circulation on September 02, 09, and 16), in which instrument I have been named, appointed, constituted and authorized by my co-heirs as their assigned attorney-in-fact to do and perform, inter alia, “any and every act and thing whatsoever that is requisite, necessary or proper to be done in all intents and purposes as them all might or could do if personally present or acting in person” pertinent the quieting and/or reconstitution/preservation of the Certificate of Titles of the real estate properties subject of said partition agreement particularly belonging to our decedent father CRISPIN U. OREAS, Sr., to which aggregate belongs to aforesaid titled property.
WHEREFORE, pending the filing of proper motion with the competent court or otherwise other applicable remedial procedure that may be prescribed by law pertinent the loss and reconstitution of the above described Certificate of Title, this Affidavit and Notice is being submitted and served to the Register of Deeds of the City of Alaminos, Pangasinan through the Central Office of the Land Registration Authority, Diliman, Quezon City in compliance with the requirement of Sec. 109 of P.D. 1529.

1. That, I am one of the eight (8) and only known legitimates of the late spouses CRISPIN U. OREAS, SR. and LEOSENIZA F. OREAS who died intestate in Alaminos, Pangasinan on 8 October 1974 and on 7 February 1989 in Bani, Pangasinan respectively;
2. That, by virtue of intestate succession, I am one of the co-owners and legitimate successors of that certain real estate property belonging to the aforesaid decedents and more particularly described as follows:
A estate property comprising of a total lot area of ONE HECTARE AND FOUR HUNDRED AND SIXTY-FIVE SQUARE METERS (1.465 h) more or less, located in Barrio Ranom Iloco, Bani, Pangasinan with Original Certificate of Title No. 29209 registered in the name of CRISPIN U. OREAS, SR. before the Register of Deeds of Alaminos, Pangasinan.
3. That, on or about late 2002 when our ancestral home in Poblacion Bani, Pangasinan was demolished for construction of a new commercial/residential building, several old furniture as part of the home fixtures of the old structure were equally demolished and disposed by the contractor;
